Tax-Exempt Status Questioned
In Maryland and California courts this August, it was decided that private schools with a tax-exempt status must comply with Title IX regulations. The decision hinged on the argument that tax-exempt status financially benefits schools, thus making schools a recipient of Federal Financial Assistance, triggering mandatory compliance with Title IX regulations and other laws.

CAPE and WCRIS signed a petition in support of an appeal of the Maryland court’s decision. Read more on the cover of our Fall 2022 Annual Update.

Support for School Choice Tax Credit
The Educational Choice for Children Act would create a federal tax credit to encourage donations to non-profit scholarship-granting organizations. Scholarships would be used to pay students’ private school tuition, expanding school choice to up to 2 million more students around the country.

The bill was introduced to the U.S. House of Representatives and Senate in June. CAPE recently endorsed the bill. President Biden will never sign such legislation. But advocates are lining up support for the future.
